Terms and Conditions (T&C)

For the use of the KCSN (Komplex Control System Next) logistics SaaS platform
1. General provisions
These Terms and Conditions govern the conditions for using the KCSN platform (hereinafter: the "Service") operated by GVM Europe Kft. (hereinafter: the "Service Provider"), between the Service Provider and the subscriber (hereinafter: the "Subscriber"). By ordering the Service, the Subscriber accepts the provisions of these Terms and Conditions.
2. Subject of the Service
KCSN is a cloud-based (SaaS) logistics platform for carriers and freight forwarders, comprising modules for transport management (TMS), customer relationship management (CRM), finance (Finance), document management (DMS), business intelligence (BI), and compliance (Compliance). The Service Provider provides the Service on an "as a service" basis, delivered over the internet.
3. Subscription and plans
The Service is available under the plans published on the website (Starter, Business, Pro, Enterprise). The content of each plan, the user and shipment limits, and the fees are set out on the pricing page of kcsn.hu. The Service Provider reserves the right to modify the content and price of the plans, except for the fee applicable to a subscription period already entered into.
4. Trial period
The Service Provider may offer a 14-day free trial period. The trial period is available without providing payment card details and may be cancelled at any time without obligation.
5. Fees and payment
- The fees are the amounts stated on the website, denominated in EUR and exclusive of VAT, unless otherwise indicated.
- The subscription may be entered into with monthly or annual payment; in the case of annual payment, the stated discount applies.
- The Service Provider issues an electronic invoice for the fee.
- In the event of late payment, the Service Provider is entitled to restrict or suspend the Service.
6. Term of the agreement and termination
The subscription is for the selected period (monthly or annual) and, in the absence of any provision to the contrary, automatically renews at the end of the term. The Subscriber is entitled to terminate the subscription before the start of the next billing period. In the event of a material breach of contract, the Service Provider is entitled to terminate the Service with immediate effect.
7. Obligations of the Subscriber
- The data provided is accurate and up to date.
- Confidential handling of access credentials; the Subscriber is liable for activities carried out with the account.
- Lawful, intended use of the Service; breaching the security of the system, reverse-engineering it, or unauthorised access is prohibited.
8. Intellectual property
The KCSN software and all related intellectual property rights — including the source code, the design, the functionality, and all associated elements — are the exclusive property of GVM Europe Kft. Copying, distributing, modifying, or any other use of the software without the owner's prior written consent is prohibited. The subscription does not create any ownership right, only the right to use the Service.
9. Limitation of liability
The Service Provider strives for continuous, high availability but accepts no liability for downtime arising from causes beyond its control (e.g. internet outage, force majeure, third-party services). The Service Provider's liability is limited to the amount of the fee paid for the relevant subscription period, to the extent permitted by law.
10. Data processing
The processing of personal data is governed by the Privacy Notice, which forms an integral part of these Terms and Conditions.
11. Amendment of the Terms and Conditions
The Service Provider is entitled to amend these Terms and Conditions unilaterally. The Service Provider will inform the Subscriber of the amendment on the website and by email before it takes effect.
12. Governing law and dispute resolution
These Terms and Conditions are governed by Hungarian law. The parties shall settle their disputes primarily by amicable means; should this prove unsuccessful, the Hungarian court having jurisdiction and competence shall proceed.
Effective: from 1 January 2026. This document should undergo legal review by a lawyer prior to publication; the company registration number, tax number, and precise penalty/warranty conditions are to be inserted into the final version.
